Judge Rejects Malibu Lagoon Lawsuit

San Francisco Superior Court Judge Ernest H. Goldsmith sides with the state on the controversial project.

 

SAN FRANCISCO—A lawsuit attempting to block the California Coastal Commission's October 2010 approval of the State Parks-led Malibu Lagoon overhaul project was rejected here Thursday by a Superior Court judge.

Judge Ernest H. Goldsmith ruled against the three environmental groups that filed the suit—the Wetlands Defense Fund, Access for All and the Coastal Law Enforcement Action Network—except on one technical issue. Goldsmith said the Coastal Commission properly "analyzed all feasible alternatives to the project" and chose the one that was "least damaging to achieve the goals." He also said he was satisfied with the mitigation measures that would be taken to protect the lagoon's endangered species.

The judge rejected the argument that removal of the lagoon's wooden bridges would be harmful to public access because there would still be a trail.

Suzanne Goode, a senior environmental scientist with California State Parks, said she was pleased with the ruling, but not surprised.

"After going over all the documents for many, many months, it appeared to me that those who filed the suit didn't have much of a case," Goode said. 

She added, "We feel quite vindicated with this decision and are glad that all the federal and state agencies as well as the major environmental groups stood by us during the whole process."

The project was supposed to start last June, but was called off when Goldsmith in May approved a stay on the project due to the pending suit. Goode said at the time that the delay put in jeopardy a $2.5 million grant for the project that needed to be used this year. However, she said on Thursday that an extension was placed on the grant pending the outcome of the suit.

Goode said the project will begin next June. It can only be done in the summer, according to the permit approved by the Coastal Commission.

Marcia Hanscom, who heads two of the environmental groups that filed the suit said she was "very disappointed."

"I think that [Goldsmith] did not grasp the issues of this project. ... He seemed very confused by a lot of the issues," Hanscom said. "And it is beyond me how he could read that record and say the Coastal Commission complied with the law. They did not."

Her partner Roy van de Hoek added, "It's distressing to know that birds, the fish, the tidewater goby and other endangered species, dragonflies, the many species that are relying on Malibu Lagoon for food, shelter and breeding in this habitat are now again placed at risk of losing their habitat because of this judge's ruling."

Hanscom and van de Hoek said they have grounds for an appeal. They said it is a matter of whether others in Malibu and elsewhere are interested in filing an appeal because they will need to raise money to fund it. Van de Hoek also said he is working on trying to get the environmental groups that support the project to reverse their position.

Goode said she was not surprised to hear that an appeal was planned. She said this would require another stay on the project, and Goode said it could be more difficult to get one approved a second time.

Called the Malibu Lagoon Restoration and Enhancement Plan, the project includes the replacement of nonnative vegetation with native vegetation and adjustments to slopes and channels in a 12-acre portion of the lagoon. Existing access bridges will be removed.

Proponents say the project will improve oxygen circulation and the general health of the lagoon. Opponents say it will harm the lagoon and that species will die. They object to the use of bulldozers, the removal of the bridges and other features.

Very sad indeed, what happened to love and compassion in the world? It seems to me that violence and destruction are now the only solution to so many problems. Bulldozing the lagoon will not address the sources of the pollution that flow into our ocean. Today is a grim day for the creatures of Malibu.

Great news. Marcia and Roy have done a great job confusing the issue to drag money out of the poor saps who buy their BS. But the fact still remains - all scientists, resource agencies, and environmental groups involved supported this project.

Now it will be up to the Malibu community to let State Parks, Governor Jerry Brown and Malibu City Council know that they simply do not want a restoration project that bulldozes the habitat at the lagoon, removes the bridges therefore creating a twice as long pathway to the beach and jeopardizing 3rd point wave. What a sad day for Malibu 3rd point and Malibu Lagoon. What needs to be done next? A petition to City Council and Governor Jerry Brown asking to pull the project due to lack of support from the local community? What will it take?

What 3rd point Wave ? Third point has been deteriorated to funky close out on south swells since 1983 when the floods filled in the low spots between 2nd a 3rd with cobblestones .

I ask that everyone go to the lagoon and look at it...don't take the word of these scumbags that are milking Millions of Dollars , your tax dollars, to do this project.
Go at high tide and go at low tide...you will see a functioning habitat.
This is a dark day for Malibu .... Our own Mayor sold out the heart of Malibu.
May the chumash spirits curse him for what he has done !!!

The voters of California voted for this bond and the bond money has to be used for California water way improvement Projects or else it goes to another project elsewhere We are lucky ! Democracy at work .
Do not Blame the Mayor for selling out to Scientist ,It is doubtful that the mayor would have been able to sway the Judge if he had been opposed to this project
This is a good day for the future the Pacific Flyovers of water fowl and Wildlife for generations to come will have a more ideal habitat to nest and be more free of Humans impeding in an ecosystem that has been dwindling due to human encroachment . The Mullets and the Gobies will have an improved lagoon ecosystem and The Steel Head may once again want to make a come back once the non natives are removed and humans are restricted and a better circulating water environment has been restored . The Osprey will be re-introduced which if you have not have had the chance to watch them hunt is really a treat to witness .
Had I thought this project would have jeopardized the waves at Surfrider I would have been selfisly opposed , But since I strongly feel this project will not impact the surf , I am all for improving the long term habitat for lagoon creatures for generations to come , Water fowl and fish don't need humans blasting their boom boxes or cheetos feeding kids walking through their bedrooms . Remolding out poor designs is chaotic for awhile but also worthwhile for the long term .

Democracy at work ??? you have to be kidding me.
At the Coastal Commission hearing one of the commissioners also sat on the Santa Monica Bay Restoration Commission and he took himself out of the vote, yet when we had this as an agenda item the Mayor Siebert refused to do the same. His conflict of interest and totally biased position of this project is not the kind of democratic process that I want. Jeff Wagner wouldn't completely oppose it because he wanted the money for his own ulterior plan. Had he been forced to simply oppose or support without trying to scam the money his own way and if siebert had taken himself out of the vote it would have been 2 to 1 to oppose. Instead he passed on letting the vote roll over to the next council meeting when Rosenthal would be there. She STILL hasn't taken a position !
Another great example of Democracy...Malibu Surfing Association's support was a letter written by Two of the members without a club vote that they wrote on "behalf of MSA and The Malibu Surfing Community".....Democratic process ??
Surfrider Foundation West LA/ Malibu Chapter has a 7 member board , only 2 of which surf and of the 2 only one was in support of the project. There was no Surfrider Foundation membership vote...if you are stupid enough to give them money they have supported this on your behalf.
Same with Heal the Bay. When members pay for little fish skeleton stickers did they get a say ? They support themselves getting paid..TRUE DEMOCRACY!!!

The voters may have voted on the bond money, but they didn't vote on this project.Just because you get a credit card in the mail doesn't me you have to start spending on it.
There was major lobbying by the proponents to acquire the bond money for this project and the rush to get this project done now is because it would be returned, as it should. Last year they tried to make the claim that if it hadn't started last June that the lagoon 'would be beyond repair'. Are you kidding me ? Go look at the lagoon and then tell me that it is now beyond repair . Steve don't tell me about future flyovers...they are there NOW in HUGE numbers. All this propaganda to make people think the place void of life...terrible.

Dear Jack. I personally fought to keep the so called compassionate conservationists from spraying round up all aver the non-native plants in order to kill them before they demolish the rest of the habitat there. I don't call this PILOT PROJECT compassionate by any means. It is a total WASTE of TENS OF MILLIONS of bond $$$$.

Dear Wendi, First, I resent your condescending attitude. Second, if you had ever bothered to READ the Malibu Lagoon Restoration Plan, you would know that the use of Round Up or any other herbicide was NEVER suggested. Why would anyone spray herbicides BEFORE they start construction? That was part of a boiler plate Coastal Commission permit that was removed as soon as the proponents realized it was included. You are welcome to take credit, but in reality you had nothing to do with it. Finally, where do you come up with this "TENS OF MILLIONS" of dollars? You know it is OK to oppose a project but you shouldn't "enhance" the truth to make a point.

Heal the Bay and State parks have now turned the lagoon into a money making machine. Most people do not realized that this proposed project is a PILOT PROJECT to be monitored for 5.5 years and if their project does not work, they will redo it again and again and again............ What a great way to totally waste money. Take care seed of the problem. Oh yeah, they could not get the money for that. Nor could they get the funding for the 200 car parking lot at Serra Retreat. You are a bunch of crooks using a green veil.

Wendi ~ thank you for reminding people that this is an OPEN-ENDED permit. an experiment and if it does not work the way they want it to -- they can come in and dredge/bulldoze again and again and again! I've *never* - in nearly 20 years - seen a permit like this issued by the Coastal Commission. Bond money gone wild. I will NEVER vote for another bond that provides money to the Coastal Conservancy, State Water Board or Wildlife Conservation Board. Not when they have approved funds for such a destructive project. I was a big supporter of these bonds and had no idea they would be misused like this.

We know that there are many hundreds of people in Malibu who now understand and appreciate Malibu Lagoon because the light has been shined on this previously mostly ignored special place in the heart of the city. We also know that there are very big stakes here, including for the guy writing as "Jack" - who - given what he has said, indicates he has been paid to work on this project for a number of years..."When the people lead, the leaders will follow".....eventually - sometimes it takes a bit of time to get their attention. We will need EVERYONE who has a heart for wildlife, for the Malibu surf, for public access and for children's nature education to get involved. From *last* October to May we created miracles. More are on the horizon for this October through May!

The judge had a heart for wildlife , The public who voted for this will still have access to the beach and the Children's Workshop tours will soon get to view an area of the Lagoon's wildlife that is not Bisected by human intrusion from the viewing Platform and the surf at 3rd point can't get worse than it is now which means it can only get better . Now Malibu needs to work on upgrading outdated septic systems and we need to turn our attention to slowly dismantling the Rindge dam and stopping Winter discharges from Tapia

Wow Andy, I don't even know how to reply to this. What does my turkey hunting have to do with Malibu Lagoon? Anyway, yes my last name is Topel. I work (proudly) for the Santa Monica Bay Restoration Commission. Please feel free to direct all hate mail to jacktopel@yahoo.com I'm sure many of you are licking your chops thinking how you can get me in trouble. Please feel free to take your best shot. However, I feel that I am as entitled to express my opinion on this site as anyone else. Maybe that helps you understand how hurtful it is to be called a scumbag. I have spent my career trying to protect and preserve the environment, as have my friends and co-workers. Just because you think you're right, doesn't mean that we are evil. Rest assured I have not made one dime on this project. In fact I have had to live with reduced benefits, furloughs, and pay cuts for the last several years. I do what I do because I love places like the lagoon and want to protect them for my daughter and grandson to enjoy in the future. Thanks for "outing" me though. At least I know that my Thanksgiving turkey didn't originate in the frozen foods section at Whole Foods. I'm sure that all of you will be enjoying your TOFURKEY this holiday season.

You didn't answer the question of when you were at the lagoon last. Maybe you should go there today, right now this morning as the tide is filling the whole thing up and you can stand on one of the bridges as the tide turns and witness the lagoon doing its thing as it cleanses itself. You could stand there and celebrate that you had a hand in destroying what has taken nearly 30 years to right itself.
'reduced benefits, furloughs, and pay cuts'.... the competition for scamming bond money for make work projects must be fierce and then to find some functiong habitat to destroy with them even harder I would imagine.
I wouldn't be so sure the gravy train is going to roll Jack .

Fresh Turkey tastes much better than store-bought. The last time I ate fresh wild turkey was when my forestry crew in Mendocino County was driving home at the end of the work day. A wild turkey ran in front of our truck. The driver slammed on the brakes in an effort to not harm it. He jumped out and found it lying dead on the road. It was uninjured but apparently died of fright (turkeys are a very sensitive bunch). We took it home, removed the feathers, and baked it. Again, the best tasting turkey of my life. Anyone have a problem with this?

Malibu Patch has been an open forum for democracy and for people to be allowed to be heard in their community. Unfortunately, some state agencies and those planning this project did NOT want Malibu to be heard. They convinced the City of Malibu leadership to GIVE UP THEIR VOICE and ask the Coastal Commission to take full jurisdiction over this project - - only Phase 2, where they KNEW there would be big concerns raised. Thank you to Malibu Patch, Malibu Surfside News and Malibu Times for all covering this issue in ways that the government agencies did not want covered. The agencies had a different story to tell than what the people who have come to KNOW and love this lagoon KNOW by using their own eyes, reading the reports and listening with their hearts.

This is so true. The Mayor said it was out of their hands...yes , they handed it away.
So many in Malibu still are confused and for the Mayor to have shelved the agenda item without a proper vote while continuing to support the project and refusing to put it back on the agenda shows that his allegiance was to the project, not the city he represents.

Just because these powers that be have won their decision to literally destroy, and reconfigure the existing lagoon channels does NOT mean it is the right thing to do. I am in awe at this lunacy to go forth with this project. The majority of the people in Malibu and surrounding areas were OPPOSED to this project. I was in attendance at the first Coastal Commission hearing last October, and was also present at Malibu City Council meetings, Malibu Township Council meetings, and Malibu Watershed Council meetings. Out of these gatherings one thing was very clear, the majority of the people were in OPPOSITION.
Today was not judgment day. Long live Malibu.

Well maybe it's true after all, we will lose precious wildlife and habitat for the sake of possibly repairing it; after all, we humans are so clever. All we can do now is hope that projects like this don't happen again. We need to think of ways to prevent more of these disasters. This project was deemed 'transparent' by the proponents yet the majority of people were never informed of it, nor do they know the projects that lay ahead. We have an opportunity to voice our opinions when it comes to the use of pesticides in our mountains that run into our ocean, as well as approaches that will spare our treasured public lands from being massacred. Attend the Santa Monica Watershed Council Meetings, the next one is on Thursday, September 22 from 2:30 - 5:00.

Apologies for the incorrect date of the meeting! I have no idea when the next meeting will be and of course September is long gone. After repeatedly contacting the RCDSM I still have yet to hear back about when the next meeting will be. I have sent several emails and gotten no reply. My guess is that even though this meeting is on record as being public, a select few are actually invited. Anyone who opposes harm to our environment by way of physical destruction such as bulldozers or by way of pesticides should attend these meetings. Email Melina Watts and ask her to put you on the list. She just may return your email.

The only way to truly restore this place is to let it alone. Bulldozers and "environmentalists" who think they have an idea are not the answer. This is such a joke. Mother nature created this place and only she can and should be allowed to touch it. A bunch of suits in an office in Santa Monica with an open ended plan and a bulldozer is certainly not the answer. Steve you are partly right. That dam needs to go. But bulldozing the place isn't gone bring anything back. If anything it is gonna stir up the benzene and other fun stuff leached from Texeco/Shell station and all of the Scott's lawn builder chemical runoff from the golf course. If you want the steelhead and osprey to come back and really need to bulldoze something, stop flushing toilets in Malibu canyon and bulldoze any house/septic tank within 200 yards of the creek and then leave it alone. Bulldozing the "lagoon" is just environmentalism gone awry. Keep up the good work Andy.

Great Point Chip , The WDF had no plan to rid the lagoon of the toxic sludge with "Benzene and other fun stuff leeched from Texaco / shell staion and all the Scotts lawn builder chemical runoff from the golf course " but the Restoration deals with it by getting rid of that AND the Cal Trans fill and all the Non Natives AND contours the channels promoting better circulation for micro organizms that need oxygen rich water when the lagoon is in a CLOSED Berm Situation !
So you want to Bulldoze the houses off Colony beach ? Andy and the Rapf family might not like that idea , and don't think that plan will fly !

It is June 1, 2012, and the bulldozers are preparing to destroy the Malibu Lagoon. Standing in front of the bulldozers are the three newly elected members of the Malibu City Council, Marcia Hanscom, Roy van de Hoek and many others, including me. We vow not to let this senseless destruction happen.

As a llawyer for over 40 years, one defect of the appellate system in our courts is that the judge has to act only upon "the record", the facts before him or her. In this case, the "facts" used to make the decision are 10 years old - the Court did not consider that it is bird, not human crap which has caused the problem, and that bulldozing the Lagoon will not stop the birds from crapping in it. Also not considered was the fact that Tapia no longer contaminates the Lagoon for much of the year with its discharges, and that the septic systems in the Civic Center area have mostly been greatly upgraded over the past decade. The Court also did not consider much less intrusive and much less expensive alternatives to the bulldozing to fix the Lagoon problem. Let's hope Judges Reinhardt and Schroeder are on the Ninth circuit panel that hears this case.

SIEBERT OUT ! It is clear he has sided with the money against Malibu.

WAGNER OUT ! Not as clear to most, but just as bad. His refusal to completely oppose the project that he knows and said is wrong just to try and hold on to the bond money for a different project that is just as damaging to the lagoon. I'd have to say that he is even worse than Siebert because it is very clear that Siebert is with the SMBRC , but Wagner is trying to fool everyone with this 'alternative plan' of his that is just to get the serra guard shack trade for the strip of his so called 'pepperdine peninsula' that the state wants to put a parking lot on.
Had he not confused everyone with his 'plan' , Malibu would have been more focused in fighting this. He shouldn't even be on the council anyways, his house is outside city limits and is supposed to live in his surf shop 5 days a week as a condition of being on the council ???

Thank you to all who oppose this wasteful, criminally destructive construction project. It is glaringly obvious that the majority of those in favor of it are benefitting from the spoils in some way. I have lost respect for corporate sellout fake-environmental groups like Heal the Bay. Is it any surprise their major funders are huge wetlands construction companies like MWH and AECOM? It will be interesting to see if their supporters end up profiting from their relationship. And after becoming suspicious of Jack Topel, I looked on his employer's website (Santa Monica Bay Restoration Commission) His responsibilities include managing the Commission's $18 million in Proposition 50 grants.
I am proud to speak out with the majority of the public who are opposed to this shameful and wasteful project. I call on the political leadership of the city council to step up and represent the community.

As an outsider, I don't see one comment in opposition to the project address any of the science that actually informed the creation, design and execution of the project. Looking over the full history, it seems that what one group considers natural is the result of years of human interventions that another group sees as damage that needs to be restored. Leaving it alone isn't going to restore a flow, absent some flooding that would rearrange not just the lagoon but much of the community around it. Where is the survey/science that supports the contention that the lagoon as is, is a good habitat for the species dependent upon it?

As an outsider you might wish to actually go to the lagoon TODAY and look at it. The breach point is exactly where it needs to be and the lagoon is flowing properly with the tide. That IS the solution to all the problems in the lagoon.
The meandering breach point was not addressed and you can dig that thing a hundred times but if you let the creek flow away from the side channels it will never work, PERIOD. The only absolute certain fact of this project is that it will hold more water when the berm is closed....everything else is a crap shoot!
As a lifelong insider , I can tell you that what started as an ugly project nearly 30 years ago , has finally healed itself to something that I am willing to fight to save.
So please go look at the lagoon. oh and when you see how beautiful it is there one of the people that are for this will tell you 'well, its what you don't see' . ??
So go there and enjoy !

I lived within eyesight of the place for almost 25 years and have studied at university level the processes that are at force here. I don't have a doctorate in coastal geology but neither do most of the people who are pushing this project forward. I have an idealistic view on this that will never happen. But why do people think they can do better than what nature does herself? I think the big question is: What do you want to restore the lagoon to? Do you want to continue to push dirt around only to find out every 15 years or so that you made a mistake and have to move more dirt around? or would you rather put natural processes back into effect, the same processes that created the place. Makes sense to me. That would mean restoring the creek up stream to it's natural state. Lose the dam. Let sediment flow naturally happen again. Which means there will be some dry times ie. no flow. During my 25 years there I spent more time than just about ANYBODY walking that beach and surfing those waves. I saw the big winter blowouts. I saw the maxed out tides with big short period hurricane swells. I've seen the greywater pipes coming out from under all the homes with foamy soapy h2o. I've been home sick with the chemical burby flu that one gets when you surf after a storm. and I've stood in front of the bulldozers scraping the grunion egg filled sand because the lifeguard got talked into moving the volleyball court. I promise bulldozing the lagoon is not the answer.

What is natural ? Not the thousands of cubic feet of Cal Trans fill that was pushed around in the 1983 amateur botch job of the ill conceived project , The Benzene and golf course fertilizers you mentioned in the sludge isn't from the Chumash and those bridges bisecting what little is left for habitat due to human encroachment is not Natural . What is natural is that the waves at 2nd and 3rd have long been ruined from Mother Nature and it will be Mother Nature that will one day rearrange the cobblestones into perhaps a better wave than Malibu has ever known regardless of any restoration to the west side of the Main channel .

I know that this project evokes a lot of emotion from both sides. Out of all the misinformation and inflammatory accusations and fallacies being shouted out, there is one I feel is so outright untrue it needs to be addressed honestly. I just don't get how people can accuse the people who work on this project of making endless cash off this project and abusing public funds. The people who are working on this project, with the exception of the hired consultants and contractors who have no control over the project or the money, are state employees or non-profit organization employees. We make the same amount of money no matter what we are working on. I manage grants and I know the accounting process. None of the project partners are making money off of this project. I wish I made more money off of high cost projects, I wouldn't have to work two jobs to support myself and my dog.

I think the main point that angers most about this project specifically is the fact that clean water bond moneys were used and the water will not be cleaned due to the upstream contaminants that will continue. Also this project was approved based on the 11 year old science and sold to the public that the water there is filthy. Indeed, it is bird poo. Another wasted bond project that will be open ended. When agencies that promote to protect the environment are making hundreds of thousands of $$ to "monitor" what come out to be bird crap in a lagoon, how do you expect people to feel!! Maybe you should scrutinize the grant a little better the next time you write one.

Hi Candy, I don't think anyone is saying the actual staff members are pocketing money. As I'm sure you know, too many environmental NPOs end up with corporate sponsors who donate large amounts of money- which either buys their silence or complicity on projects that benefit those industries. The money is not pocketed by the staff, but they do benefit in other ways when their organizations are funded. We know Heal the Bay was paid for "consulting" and also that they are funded by some large wetland construction "restoration" corporations who do government contract work.
I'm also aware of political tactics officials use to avoid public notice until it's too late for the public to fully react. This is exactly what happened with the "restoration" project. There are so many things wrong with the big picture, I feel I must speak out.
Why wouldn't environmentally-minded decision makers want the least invasive bang for their buck? Why was this project designed mostly by big contractors? Why won't they listen to the scientists who say the goals can be accomplished with less impact on wildlife? It's obvious they are purposely spending the most amount of money they can- just because they think no one will question them.

malibu surfrider beach is a spirit. its hard to see that now after years of abuse. i still dont understand upon coming to surfrider beach revered for the perfect wave for hundreds of years by the indians and by every surfer in the world the county of los angeles could put up a tuff shed garage right at the entrance to surfrider beach and a a really poorly though out bathroom facility. why didnt the city oppose these. why didnt the people understand.
of course now with the lagoon project we must distrust them. look at the track record. as a long time malibu surfer i am totally embarrased how the government has been allowed to hijack malibu. i applaud andy lyons and his energy to highlight the deceit of those who do not understand that they are ruining malibu and killing the spirit. they will not stop they must change everything. but they know not what they do. thank u again andy

Because of the toxic nature of the sludge in the Lagoon , from either high concentrations of Trapped bird poo , or local septic leechfield discharges or from the old gas station leaky underground storage tanks that Chip mentions had leaked benzene or the sediment build up from Sewage discharges of Tapia and the upper watershed , the Sludge needs to be treated as Toxic Hazmat when trucked out and cannot be used as fill elsewhere . To protect the Lagoon from further contributions from the upper water shed there will now be more pressure than EVER before to prevent pollution from entering the Creeks water shed. Many get fooled by the superficial appearance of a patient but as a doctor recently told me , a cancer patient can appear healthy for along time before it becomes too late for a successful treatment .

It is going to be a holding tank for the future sewer . The legacy park is already purple piped to take the waste water there and there has to be an emergency release pipe from the treatment center , which is going to be somewhere right in the civic center area, when there is a power outage or some overflow due to excessive rain. Tapia has done the exact same thing since it was built....dumping raw during heavy rains or power failures.
Steve , I'm really glad you support this dredging project. You can bla bla bla all you like , Malibu people are not willing to give up and I guess that is why you are still trying to sell this project.

Because you never understnad anything Steve. The current lagoon doesn't hold anywhere near what the propossed lagoon will when it is dugout to 9 feet deep all the way back to the golf course. There is no way to calculate how many more millions of gallons of water(?) it will hold.
Heal the Bay is pushing the lagoon project AND the sewer project with the same reasons, that the lagoon and surfrider are polluted from leaching septics. And when the USGS showed that the problem wasn't humans but birds our city council didn't decide to oppose either project.
This was brought up at the April ,2011 council meeting when Izbicki brought in the findings....you can watch it on video. And when Pam Ulich asked for some clarity Siebert quickly says that he has left and that they already asked so many questions of him. But then the slide pops up and he the allows a guy from SMBRC to decipher the data , he wasn't a speaker that night, yet he let him give his opinion of data that wasn't his . I've asked and was told that that move was very unusal. Here we had a report that cost $150k that was paid for by the city that would argue against the septic ban and the lagoon project and our Mayor kaboshed it !!

I agree, Andy. This unfounded perception of people who live here and who sacrifice on many levels to do so is disturbing. Yes, it's beautiful here - but most of us are in endlessly stressful fights to keep it this way. As were the generations before us. We drive long distances to work, go through mudslides, fires, lose of our pets to coyotes and rattle shakes. By far the majority are people with average incomes working very hard to live here -

Malibu attracts passionate people who work endlessly to protect her. HOW else do people think that a city within a stones throw of LA has stayed so open and rural? Hard, hard work. It's a rare gem of a city, a miracle - really. I really don't appreciate the distorted bias against the people who live here as shown by this comment . . .

The PEOPLE did not VOTE for the remodel of Malibu Lagoon using bulldozers and herbicides. The people voted for feel-good buzzwords in a summarized ballot statement (few read the full text in the voter guide). The millions and billions of dollars mentioned in those ballot statements' summaries are so large as to rate Malibu Lagoon a small recipient. VOTERS sometimes feel empowerd that they are doing the right thing to allocate significant funds toward ideological concepts, ignorant of the funds' limited purpose and creative, interpretive eligibility in the future could use the money as demonstration porjects, pilot projects, and do-over programs.

Before the new moon extreme tides taper off you can see the Lagoon breathing with fresh sea water flowing in and flowing out with the tides just as it does after most rains and as we get into the half moon tides that are less extreme the berm will have a possibility of closing or silting up unless alot of rain enters the watershed . When you are down there please bring a video camera and film the waves at 2nd and 3rd point especially if there is a south swell . $ 100 dollars for any footage Documenting any bonafide World Class Waves that will be ruined , (not at 1st point ) . Then It would be really cool if someone other than Andy could inform us to exactly in fine detail how the waves would be ruined by the Restoration Project . But then , how can you ruin waves that have long been ruined? Marcia , you want to make a stab at it , Roy ? Athena ? , ( I will be alittle suspicious if someone uses the thumb over the garden hose theory so please try to be creative in the scientific fundamentals of hydrology .

Should we listen to Mark Abramson who told me he was going to protect the wave by placing the 4 trees that are going to be cut down in the creek in an attempt to 'point' the creek in the right direction ?
He has NEVER surfed and is one of the lead guys of the project.
Or Bob Purvey who hasn't surfed for how long ?? he says 6 years but I can't even remember him there in the last 15 years.
Or you ?? how often are you there? you have given up short boarding for the last 10years plus so really what do you care if 3rd comes back. It almost seems as if you get some sort of joy out of the fact that it isn't what it could be. Your days of progressing your surfing I guess are behind you and aren't too concerned to do what would actually help the wave there for future surfers.
Go ask ANYONE that surfs there what the solution for the wave is and they will all say the same....PUT THE BREACH AT THE TOP. That's where it is right now and the sand is being laid up as we speak in the right places, but you are such a debbie downer and mister negative you can't be happy that we will have a chance to actually have the creek pointed in the right direction at the beginning of the season for once so that when the rain does come it will be forced to send things straight out. Until then it is pulling out sand and making a really nice sand bar... oh that's right that isn't the cobbles of '69 but are you so opposed to surfing a sand bar point ???

The creek is supposed to flow STRAIGHT OUT TO SEA .
How is one of the biggets watersheds supposed to flow all the way down from the valley and not flow into the sea ??? I'll tell you how ....you dig a big 9 foot deep hole at the end of the line . And if you don't think that messing with the velocity of the creek flow by widening the lagoon 9 feet deep from the golf course wall to the edge of the Adamson house, well then I don't know what else to say to you.
And when that huge body of water is closed to the sea the prevailing winds will push the water to breach by the Adamson house and when that does with that lakes worth of water ...forget about it. DONE.

For some reason or another I can't get this link but in your own words please describe how the waves that have been ruined for years will be ruined at 2nd and 3rd if the restoration project goes through . Since you have an understanding that reef topography dictates wave quality ,how can the Cobblestones get re-arranged in a worse configuration ? I have been studying the evolution of Malibu since 1969 when 2nd and 3rd were transformed from a crappy wave like today into a world class wave after the sediments settled during the floods in that winter , that lasted for about 15 years until the cobbles got rearranged again in the floods of 1983 but not in the best way for wave quality . So since you say the restoration project will ruin the waves , back up that claim with an articulate description of exactly how that will happen or do not make that Claim . My offer still is on for your footage of these world class waves at 2nd and 3rd that are supposedly Threatened . Any body ? $100 dollars !!! ,, Come up with the proof or cut the crap . I respect different opinions on the lagoon project but not if it involves distortions and myths such as bulldozers causing " wild life Genocide" and "extinctions" and " ruining the World class waves" The Restoration will not affect the Main channel therefore not affecting the surf .

Almost the beaches in Southern California are shrinking . Most of the watersheds in California have been manipulated by asphalt , concrete culverts , dams , Storm drains so very little natural sediment is actually getting to replenish our beaches , Broad beach is case in point ,, But maybe you have it on good authority That Steve D . And at low these low tides you can see where the sideways discharge of the lagoon during a misplaced breach cut a huge trench at 1st point diagonally towards the pier.
Nothing has been the same since they did this the first time and nothing was done with the design of this plan to address the issues that caused these problems.
There is NOTHING in the plan about the one thing that really makes the whole lagoon work...cleans the lagoon, keeps the creek away from the Adamson house and fixes the wave and that is when the breach point is at the top.
They hadn't considered until right before the hearing when I started making noise about it with Abramson. Then in a last ditch attempt to gain surfer support they said they were looking into the breach point. State Parks has no authority to promise that. none.

There is a photo in the offices of Lou Busch Jr taken around 1930 showing the creek running in front of Adamson House and breeching exactly where it does now.

I'm not saying that's the way it should be - it should breech straight out - but nature is random and creeks and rivers go where they want to go. Even back then, sometimnes it went straight out, sometimes it bent to the east.

The natural design of Malibu Lagoon is flawed. There is not enough rainffall and flow water to cleanse it year around, and the closed sandbar berm blocks it six months out of the year.

Forget about human inputs and septic tanks and stormwater runoff - hundreds and thousands of birds deposit many tons of fecal matter over six months - and it stagnates and fester in the closed lagoon.

If nature needs help, create a permanent breech - exactly where it is now - and let tidal forces do what rain and stream flow can't.

Just try it. If it doesn't work, then do something else. But just do the permanent breech for one year, see if it fixes the lagoon.

So simple.

Somebody show me a photo of the creek running up against the Adamson House in July like it did this summer. Steve show me one photo of it breaching inside of the Adamson house...all the way inside by the volleyball court like it has done recently. Somebody Show me a photo of a huge body of water back there in the middle of summer like it has been since they did this the first time.
I've seen the photo Ben is talking about and the creek bending towards 1st is way out to sea. That is after the main thrust of the storm as the storm water starts to slow down it can't keep pushing over the newly formed sand/cobble bar and then the creek just bends inside of the sand bar and then stops flowing all together.
Steve... when you say that all the water in there doesn't matter , that's a joke. That thing at capacity going out in the wrong direction digs a trench so deep that it can't undo itself. And then the constant trickling of water keeps it there. So when this thing is dug out the way they want to do it....I can't imagine the damage to the point if it was to go out sideways... a sand bar in the pier??
And Ben... a permanent breach would be nice but I would just really like to see a designated point that if the breach starts to go past the beach tractors push sand to redirect it up the beach. They put sand berms up at zuma to protect the lifeguard towers, why not at Malibu? To keep it permanently open would involve boulders and that would never be allowed.

Do you remember in 1986 when the gravel /rock island was formed inside first making an impossible section and screwed it up for a few years until the natural currents and swells groomed the point back to perfection ? That year the the creek flowed out at the volley ball courts , I remember clearly because I bet Roger Kelly $25 dollars that it would take aleast a year to erase the bar island that you had to wade to at the Volley ball courts

Hey I can't lie and pretend to live in the past . When the best surfers in the world used to come to Malibu from the 1970 - 1985 or so they didn't come to surf 1st point . They came to surf 3rd or 2nd because it was a vastly superior wave , Yeah, we would ride 1st point but usually only as a means to transport yourself in after a long go- out on the outside points . Today when the worlds best pros show up where do they surf ? Allen is rarely ever seen at third , Joel Tudor , Ryan Condor , Donny Wilson . Schaffer , Reno Abeilero , and too many others .And I would say that I usually see you Andy at 1st point also ,, I have yet to see Kelly Slater go out at 3rd point , he always surfs 1st point , Now why is this ? Why aren't the best pros in the world moving here to surf 3rd and 2nd points like other World class waves in the world ,, well maybe because it it not presently a world class wave out there , yeah there is the odd flukey one now and then that you can get a few turns on before it closes out or one that connects through from 3rd to 2nd and the odd one that can come through from 2nd into 3rd , but a world class wave has better than a 1% excellent wave count during a swell . I have great memories of Enjoying those magical days , It is positive to accept the truth,, that the only permanent thing is change . Articulating a need for the breach to be at the top while making a healthier habitat for all the wildlife is not a Lame attitude !

Why not just work on having the breach where it should be when it needs to be open, reduce the amount of water that the lagoon holds and get new non-biased water testing of the lagoon water by people that aren't responsible for also doing the project.
There is no guarantee where the lagoon will breach under this plan, that should have been the first thing considered when trying to fix it.

My video I just put up shows the lagoon flushing out after high tide. This was shot 17 days after it breached. I tried to follow some seaweed that was pushed up in the lagoon and was going back out to sea.

You know the environment and the animals are always the very last things people care about... if they even think about that!!! It has always been a fight for this! I remember in the late 1980's when I was doing a project I picked endangered species... boy was I blown away when I saw ALL the RECENT (within the last 20 years) species that were now gone from this planet. And we all know why! It's people - development... lack of education.... greed.... ignorance... anger....etc. - not realizing that we are all ONE that everything one does - no matter what - comes back in some effect!
Peace to all the animals and plants that have suffered and will suffer due to humans not knowing that their true function is to protect this planet!
The Malibu Lagoon needs protection from the "environmental" groups state parks, etc. - Isn't that ironic! that these groups are supposed to protect - and they really think they are! If that were true, then wouldn't they want to use a plan that was less deadly!? wouldn't they want to sit down and work together with wetlands defense and others?! Wouldn't they want a plan that REALLY cleans the water - up stream - at the beginning points?! This is all about money - holding on to a bond - pretending to use it to clean the water... coming back in five years and making more money to "monitor" it goes on and on... a wildlife conservation board that gives millions - only with 3 board members??? What a stink I smell and it's not the Lagoon!

I found Jack's comments to be spoken with forked tongue - out of one side of the mouth he says, "I have spent my career trying to protect and preserve the environment"
Then we discover that he killed his own turkey (oh how pioneering!) and makes fun of those who eat TOFURKEY... Although not all animal activists are veggies, I think it would be more ethical if they were - I personally don't eat anything with a face! When I was very ill the doctors wanted me to eat fish - I was so sick I let it happen for a few times and then realized what I was doing! I then got myself well without having to go against my beliefs - lots of veggie soup, supplements, and rest! One can get really creative making veggie dishes!
Personally, I think hunting is archaic and quite cruel. Let the wildlife do the hunting...
Jack - listen to what you preach "Just because you think you're right, doesn't mean that we are evil".. this comment can fit either way! But I think it evil to kill an animal - either by hunting or by bulldozing! We kill millions of creatures daily just by breathing, walking - existing! Must we then intentionally kill?!
The reality is that MONEY is being taken to KILL. That's it - plain and simple. Because no matter what, this "restoration" project will destroy life in many forms.

A bulldozer was used to grade the foundation where you are residing Ms. DeClario and organisms were DESTROYED , KILLED, or MURDERED as you say . The road you drive on was bulldozed and killed countless critters , your radiator has a collection of death in its cooling vents .
I respect the fact that Jack like the Chumash experiences the hands on karma and spiritual experience of killing his own Turkey , I, myself will not eat an animal that I am not willing to kill gut and , Clean , I do not eat beef because I will not kill a cow first hand , I will not kill or eat a sheep pig or lamb , . I find it deplorable that people will eat an animal for which they have not partaken in its death at least once . Instead they pay someone else to kill and dress their food without having to deal with the ritual of the life exchange . The Restoration Project has extraordinary steps in minimizing any loss of life in exchange for creating an ecosystem that will allow more life forms to flourish than their is now for future generations to come instead of the slow decay that a cancer patient has to suffer

You mention the Bulldozers not being a natural Process , you are right . There are alot of unnatural processes going on . the Cal trans fill was not natural . The Benezene , the septics , the walking bridges , The Pch bridge ,Malibu canyon road and on and on . The Cal Trans fill can be taken out with shovels and buckets but would take a long time but hey I am cool with that even though it will stir up the toxic sediments also . But like I said before the toxic sludge is to be treated like Hazardous material .
As long as the Main channel has a clear shot straight out to sea without any manmade obstructions , Another perfect wave has the opportunity to recreate an ideal cobble contour maybe better than anything we have ever seen or heard of , I have watched the Main channel blast out many times in flood and the side show channels to the west that are kind of a billabong do Not affect the course of the Main channel in a straight shot out to sea when the creek is in full flood , Once the Lagoon has been breached and drained it doesn't matter how much water was initially in the lagoon because it has already left the Lagoon . Keep the breach high as possible because it naturally wants to head east , Surfers should be able to work out a deal to be part of some kind of Process to Maximize the power of a 50 year flood that can transport rocks cobbles and even boulders out to the 3rd point area . But Breaching manually is not a natural process either , Or is it ?

There are many UCLA Historical ARCHIVE photos that show the Malibu Lagoon as Andy's worst nightmare of being a holding tank since the 20's . When the berm has been closed in the past , the creek accumulates runoff , some years more than others thus becoming Andy's Evil Holding tank . When the lagoon receives more water than it can hold , it breaches at the lowest point on the sand berm . That could be at third point or it could be at 1st point depending on the year. It does not matter how much water accumulates in the Lagoon it will eventually breach due to natural causes or Elf Manipulations . I have been known to be an elf causing such an infliction on the berm in order to keep the berm away from 1st point and that was b4 the 1983 restoration project .. But mother nature has a mind of her own and I bow in reverence to her plans and accept her plan as it has produced some of the most amazing manifestations of perfection ! Patience is key !

Patience ??? it has taken nearly 30 years for the lagoon to recover from the first hack job to look natural and balance out.
Please show me a pre 1983 mid summer closed berm photo with a lake behind the colony that reaches all the way across to the adamson house or for that matter anytime of the year. None exist like the current closed berm lagoon prior to 1983...none.
"When the lagoon receives more water than it can hold , it breaches at the lowest point on the sand berm ." .... Steve, when they dig it to 9 feet deep all the way to the wall of the golf course how much water coming in is that ?? How much will it be able to hold?
The other thing that you don't get is that when you have a huge lakegoon back there the berm stretches the whole point from top to bottom. The water behind is not just 50 yards wide on the berm, more like 300 yrds maybe more. All that surface area of water behind the berm allows the lagoon to recede UNDER the berm through leaching at low tide. The USGS actually did studies to measure the [bird] fecal matter coming through via leaching.
Even as it is now , the lagoon is set up as a giant leach field and can keep from breaching with huge amounts of incoming water.
The proposed plan might expand that capability to the point that it doesn't breach through a whole season, maybe longer. No one knows for sure.

I am not good at getting pictures downloaded because I am a Technical neanderthal but go to Ecomalibu.org and find the link to the 1922 photo that I gave Bob Purvey . Not only does it show a channel finger of the lagoon extending behind the Colony but it also shows signs that the lagoon breached inside of where the Adamson house would have been had it existed . Or I can show it in Person because the UCLA Copy is grainy and is best to look at with a magnifying glass . It was photographed fairly high from a Biplane on what looks to be a fall or winter day before the lagoon had been able to breach

RMC Water ~ It's Chinatown, Jake, I mean, Andy! Wow. I checked out this website you posted to see if there was anyone I knew who worked for this company. This woman, Catherine Tyrrell, is former Vice President (in charge of securing environmental permits) for Playa Vista developers (built atop some of the historical Ballona Wetlands); she is also a Board member of the Friends of Ballona Wetlands who signed a deal to support Playa Vista and who sent in a support letter for the Malibu Lagoon demolition project. AND - she is current President of the Santa Monica Bay Restoration Foundation - which is the nonprofit entity paying all of the salaries and expense of those who are now in charge of managing the Malibu Lagoon project. Oh - and she used to work for the Regional Water Quality Control Board....the ones requiring the sewers for Malibu.

The stink is this project... a bunch of agencies working off each other and putting the bucks into each others pocket. I understand the need for jobs - but not at the expense of the environment and animals!
There is NO justification for this project! There have been many alternatives given and it's been said that the project will NOT clean up the water - yet these agencies that are all "in" together ignore this! Plus it's all laid out real ducky - monitoring in the years to come - more bucks in the pocket at the expense of the environment and animals!
I always felt that the Lagoon issue was twined in with the sewer issue!!
There's so much corruption being uncovered with this thing!!!

Steve - I would suggest doing your own digging... It doesn't take long to see the trail..
I did all my investigation on my own... (no one told me or gave me stuff). It was quite easy and quite shocking. I'm not one to follow - or to "belong" to a group - it was just natural to have found Wetlands Defense. It makes more sense to me to do ANY project with as little impact as possible.
Sit down at your computer and start connecting the dots! It will all unfold - one link leads to another and then another and pretty soon you'll find out why my new saying is "the more I know the more I wish I didn't know"!
Do yourself a favor and start with www.savemalibulagoon.com - the links and info are all facts (none are "twisted" - "just the facts mam, just the facts"). And the links will lead you to other sites. Also, check out some of the CC videos (Aprils esp.)... check out the agencies and who the people are and follow the trek back to where they were!!!and what their private agendas are...
Then go and get the water board meeting info... There is so much more you can look up... just do it. And find out for yourself why we are protesting this "restoration" project. We must question everything - not just accept!

Depends on your immune system .The Lagoon rarely scores a healthy grade on its report card Their are signs all around the Lagoon to NOT have contact with the water . The berm has been breached so now the lagoon water is mixing with Sea water . There are safer places to swim . Beaches that have lower concentrations of residential beach septics that could be faulty are less likely to be leeching towards the beach . I recommend Zuma

Speaking of the Breach in the lagoon , Have you noticed how far the opening has migrated to the east in such a short time ? When it was first released, it pretty much went straight out to sea, now it has bent east with sand building up on the ocean side as a result of the prevailing currents . At this rate how long before it reaches down towards 1st point on its natural migration ? or will the breach silt up and close before that occurs ?

What good is it anyway for someone to tell you something? Why would someone blindly believe what others say anyway?
I find out the truth by myself - with my own mind doing my own research and doing research to counter the other research and still delve. Also being "a fly on the wall" is another way to discover things. Oh and as you go by people talking - you be surprised at what you hear.

You know what I say... go look for yourself. walk around at high tide and low tide...look at it from the pch bridge , from on the beach , on the foot bridges and the long path....check the whole place out.
That is the problem...nobody is just going there and looking at the treasure that we have that is going to be 're-done'...call it whatever you want...it is a HUGE project and people will make a lot of money on this project.
And when you say "I don't see why you need to do such a destructive project...it looks beautiful in there" the answer is 'it's what you don't see' substantiated with their own scientific data , self serving scientific data.
you know what i don't see in there??? a need to do this project.

If you want to learn about the lagoon , go there.

I guess you have to be your own judge . Hear both sides and weed out the distortions and try to figure out the facts from fiction . There are some strange underlying angles to all this and I can't just sit back and allow distortions to become fact . Both sides can have valid points . Some people fear a negative change , I see a positive change that will solve alot of on going problems that will eventually help surfers health and create a healthier ecosystem for wildlife for generations to come . Doing nothing solves nothing . I'd like to see the Osprey and the Steel Head make a come back without those Bridges intruding in a world where humans have continually encroached on a dwindling wildlife habitat . As a long time surfer here I do Not fear any Adverse affects of this project in the surf zone .
I just read in the paper today that the PCH Solstice bridge bottom will be jack hammered and bulldozed to create ladder pools for the return of the Steel Head , YEAH ! Man giving back what man has taken away !

In Your investigations have you found out that the Waves at 3rd point have been poor for years and currently below average quality and really cannot be ruined by any Project because they already are or that if the waves were good that The Restoration Project would not adversely affect the Cobblestones nor the waves at 3rd ? Educate yourself from other than one source on the historical evolution of how the reef at 2nd and 3rd point has changed through the ages , for better or worse , Nature has and always will dictate the destiny of every rock in the surf zone regardless of the historical fluctuations in the lagoon . The Lakegoon in the 20's preceded the epic waves in the early 40's, then the bottom contours became poor again during the 50's and 60's til the epic winter of 1969 which produced world class waves for 13 + years , Now frustrated surfers wait for another epic storm to rearrange the bottom . Could be this year , La Nina (doubtful ) or it could be in 50 years . Til then way too many aggravated surfers viciously prey on the limited resources at 1st point . Keep your fingers crossed for 10 inches an hour in the creeks watershed .

I'm sorry that you have to endure the ego tripping that sometimes occurs on PATCH - but there are some good points here and there and actually it's just that many have their own strong opinions.
I mainly focus on the animal and environmental issues. I think that any project that will intentionally harm animals-plant/environment needs to go back to the "drawing table" and get advice from those that can do the project with less impact on animals-plant/environment.
Andy Lyon is the dude that knows about the surf.

I appreciate your input, but like so many others you inject statements that vilify either the proponents or opponents. You suggest that I visit the opponents site, but you don't give alternative sites to explore the proponents POV. I understand that you are opposed to the project,but you stated that the proponents of the project "will intentionally harm" wildlife? So are you saying that the proponents want to kill animals? Admittedly, I am not a scientist, just a poor, broke (potential employers take note:) Poly-Sci/History major, but much of what I have learned over the years has been displayed in real time on this site. I guess that's why I'm intrigued. I am neither for nor against the project itself. However, it is really interesting to see some of the theory I've learned play out in real time. This site is a great timeline! I don't know if the opponents are right or wrong, but it is fascinating to see one of the first political axioms I learned unfold in front of my eyes. Watching the project opponents switch from attacking the project to attacking the proponents as soon as the ruling was announced was a classic case of "if you can't attack the message, attack the messenger." And I'm nor saying that the opponents are the only ones who have done this. That's just the most recent thread I picked up. I thank you for your input and I hope you don't feel that I am "picking" on you! I admire your courage and spirit and your willingness to speak out!

Oh I forgot to ask you Andy ,, How is Andy going to single handedly fix the wave ? So you admit , The wave is Broken ? Then don't say you want to protect the wave from being ruined because it already is .. Obiviously it is clear that just the mere fact of the berm being breached at 3rd doesn't fix the wave or are you saying you have fixed the broken wave ? Is it Fixed Andy ? Did you make the wave a world class wave ? Do you think you have the power to fix it all by yourself ?

Everyone knows that having the breach point at the top of the point forms a better wave, but for some reason it has been made illegal to maintain its location. And for some reason you want to throw any hope of getting the right to take back control of the breach to these landscape architects that don't surf.
Wouldn't it be nice if we could just start with the breach and have complete control of the location to see what would happen first without digging anything up?
Now that would be an experiment that would be worth doing.
Maybe the good Dr. Mark Gold should take be considering The Hippocratic Oath:
Primum non nocere... "First, do no harm"

Just having the breach at the top does not guarantee a better wave , It only makes the possibility somewhat greater , Although I agree that the breach should at 3rd before a BIG storm it is over rated to think that having it breached year around would rearrange Cobblestones in a beneficial formation , Just because you point the hose in the desirable direction doesn't mean the PSI's are great enough to move rock , You need a Mack Daddy Flood , not a dribble ,, As it is now , the breach has turned east and will continue to do so unless a mack daddy Storm blows out the berm , With slack half moon tides and little to no water coming down the creek the breach has a good possibility of closing up again . If it stays open it will eventually pour out at first point , You have to get permits to keep bulldozing the breach to get it stay at the top . But You know the Fish and Game / Audobon / Environmentalist will have a fit because it is natural for the Lagoon to become full being that it sustains a temporary natural eco system that benefits wildlife and the Pacific Flyover

ICandyMalibu , Here is a perfect example of what I am taking about , Allesandra DeClario States that this project will "INTENTIONALLY HARM -plant/environment" ,, but In fact there are great measures in the protocol for this project to go to great lengths to avoid the loss of any life . Her accusation is an example of pure dis-ingeniousness ! Three weeks prior to any work being done Animal loving Biologist will relocate any creatures they can find to a temporary home before being re-released back into the Lagoon , There have been distortions of MASS GENOCIDE and EXTINCTIONS , that Murders of BIRDS deer raccoons , coyotes, fox , Gobys Egrets , Herons Will occur .. LIES LIES LIES

Poor iCandyMalibu! ...just trying to help you out: Also check out what was said at the April City Council meeting - just go to the City site and click on archives of the videos and go to the date (I think April 11) listen to what the scientists say. (it's near the end of the Council meeting).
And really with all good intentions, can a biologist really locate ALL the creatures that will be harmed - think about it. PLEASE!
Find out about the goby and how it survives and the type of water it really needs...
Find out about the snowy plover and how it makes its nest - and the season it mates
Find out when this "restoration" will be happening (then compare to the nesting seasons, etc.)
Find out about all the native plants that will be destroyed
I encourage you to do your best icandymalibu to find out the facts for yourself and don't listen to any of us here... you find out for YOU and you make your own decision.

I don't know why Steve has to put people down and call them liars!?
We all have our own opinion - that's all there is to it. No need to slander others!
Just find as much info as possible and check it out forwards and backwards... then make YOUR decision from what you decide not what we say!

Steve, I don't think Alessandra is lying. She is just very passionate about her beliefs. I admire her beliefs, as much as I admire yours. I'm going to give her the benefit of the doubt and assume that she was being sincere about the "Poor iCandyMalibu" statement. Although It did sound a tad condescending, or maybe just sarcastic. Anyway, both sides should be able to back up their claims! That's what's so frustrating about this conversation. Too many accusations with no factual information to back them up!

How many Coyotes , deer , Raccoons , Squirrels , Egrets , Gobies , Mullets < Herons, Sea gulls , sand pipers , dragon flies, Hawks are going to just fold their arms or wings or fins and defy any Bulldozers/ tanks like the Chineese man in Tienanmen Square ? Answer :None, because they won't be there . They will have been removed by Field Biologist over a period of 3 weeks . Native plants as well as non natives will be removed and then natives will be replanted to help filter out any contaminants that The lagoon harbors . Poor oxygen circulation will be increased that will help break down bacteria buildups and create an ecosystem that will enrich organisms on all levels of the food chain . All of this and the Surf won't be negatively affected . A win win for all creatures for generations to come ,, How ever residence in the Colony will not like the tourist who will be taking the trail closer to their back yards , you can't blame them for lobbying against this project . It is understandable

Sorry icandymalibu for the mis-communication. When I said "poor" I meant that you had to endure our back and forth stuff! I wasn't being sarcastic!
I have done my best to give as much links, etc. to find out how if what I say (or others!) is factual information.
Ian Bryant (Authorized Representative) is a good person to get some info from re. the water conditions and some other environmental info...
Also, it finally was admitted by Suzanne Goode (and others) that this project will NOT clean the water (the real issue is UP - Tapia etc)... and that this is an "experiment" - they realize they screwed it up the first time and admit they may have to come back and do it again... in fact, Heal the Bay is down in to be the ones to "monitor" (for more $$$). Greenwashing! I don't like "bad-mouthing" which is why I ask people to find things out for themselves. It seems that all organizations get corrupt at some time or other... even Greenpeace had problems - but it turned out to be a benefit because we got the Sea Shepherd to emerge from it all. I would love if the agencies that are in opposition to this project and those that would like to see it go forward would sit down together and go over EVERYTHING and come to a middle path decision.

I REALLY wish you luck to find out for yourself what you think.

If "everyone knows that the having the breach point at 3rd makes a better wave" , then they would be half wrong . You need a Honking flood to put some PSI"s in your hose to blast boulders around , Presently the breach is out at 3rd but the waves have not become world class , How come ? Just because you point and Hope for Change doesn't mean we are Entitled to get what we spoiled surfers want when we want it ,, Patience,,, Mother Nature needs to be involved too !

There is a failed wetland 'restoration' near my house in Manila Dunes.
The faux enviros said that we had weeds, gotta pull them. Even when adverse impacts showed they kept on pulling. It seemed money-centered.
NOW- our wetlands no longer function, the vegetation was removed so thoughtlessly
that our wetlands drained, trees died and a wasting process has begun.
It is a little late for us, but it is not too late for Malibu. take care of your shoreline,
take nothing for granted, bull dozers do not belong on a beach.

I walk Westwards almost daily and I have never seen the variety of life that I see at Malibu Lagoon. Yes, there are hundreds of Seagulls. Where are all of the hundreds of types of birds, the weasels, the goby, the heron and the many others? The Zuma Lagoon is a totally different ecosystem and should be treated as such.
